By accessing or using Nimlyst services—including our CRM, lead generation tools, marketing automation, virtual assistant placement, and FastTrack™ programs—you agree to the following Terms of Service. These terms outline your rights, responsibilities, and limitations when using our platform.
1. Acceptance of Terms
By creating an account and using Nimlyst, you confirm that you accept these Terms of Service and agree to comply with them. If you do not agree, do not use our services.
2. Services Provided
Nimlyst provides an all-in-one marketing and automation platform, including:
CRM (Customer Relationship Management) system
GeoLeads™ and LitLeads™ lead generation tools
AI-powered voice and SMS bots
Nimlyst Ads™ campaign launcher
Onboarding FastTrack™ services
Virtual Assistant placement
All products and services are considered delivered upon onboarding.
3. User Accounts
To access the platform, you must create an account and maintain accurate, up-to-date information. You are responsible for all activity on your account and must keep your login credentials secure.
4. Cancellation Policy
To cancel your subscription, written notice must be submitted at least 3 days prior to your next billing cycle. Notices received with less notice may result in the next billing cycle being charged.
5. Usage-Based Platform Fees
Upon CRM activation, you receive a $30 credit. After that, usage-based charges apply:
Outgoing Calls: $0.028/min
Incoming Calls: $0.017/min
AI Voice Calls: $0.19/min
SMS Texts: $0.0158/segment
Emails: $0.0034/email
Premium Triggers & Actions: $0.015/action
All fees are automatically billed based on usage.
6. Nimlyst LitLeads™ Terms
All lead sales are final and non-refundable
No accuracy or conversion guarantees
Leads are delivered only inside the Nimlyst platform
You are responsible for your keyword choices and must comply with all laws
Nimlyst is not liable for legal issues from your lead usage
7. Payment Terms
You authorize Nimlyst to charge your provided payment method. All payments, including subscriptions and setup fees, are final. No chargebacks, disputes, or refund claims will be honored. Platform access equals service delivery. Nimlyst reserves the right to pursue legal action for fraudulent disputes.
8. Refund Policy
All sales are final. No refunds will be issued under any circumstance, including:
Subscription non-use
Lack of ROI
Dissatisfaction with AI or leads
Setup/onboarding dissatisfaction
If you're on a trial, cancel before it ends to avoid charges.
9. FastTrack™ Reservation Commitment
Your $97 FastTrack™ reservation:
Locks in a discounted setup fee
Is final and non-refundable
Must be paid in full within 30 days
Authorizes Nimlyst to pursue unpaid balances in collections
Forfeits all onboarding services until full payment is made
Waives all chargeback rights
10. No Guarantee of Results
Nimlyst makes no guarantees about performance or financial outcomes. Past results, testimonials, and case studies do not guarantee your success. Your results depend on effort, execution, and external market conditions.
11. Late Payments, Penalty Fees & Suspension
Late payments incur:
10% monthly penalty on unpaid balances
Immediate suspension after 1+ day late
Accounts unpaid after 30 days may go to collections and legal action
You are responsible for legal and collection costs
You waive all rights to dispute charges once services begin
12. Termination
We may suspend or terminate your access at any time for any violation of these terms or platform misuse. Termination does not entitle you to a refund.
13. Limitation of Liability
Nimlyst is not liable for indirect, incidental, or consequential damages. This includes lost profits, data, business opportunities, or revenue.
14. Indemnification
You agree to indemnify and hold harmless Nimlyst and its affiliates from any claims, legal costs, or liabilities from your platform use, marketing activities, or violations of these terms.
15. Modifications to Terms
We may update these Terms of Service at any time. Continued use of the platform means you accept all changes.
16. Governing Law
These terms are governed by the laws of the State of Wyoming. Any legal dispute will be resolved in state or federal courts of Wyoming.
Wireless carriers are not liable for delayed or undelivered messages.

Standard message and data rates may apply. Message frequency depends on your usage and preferences. Contact your wireless provider for your plan’s details.
